1. Who We Are

Vencer ("we," "us," or "our") is an online service that generates personalized college planning and scholarship guidance reports for Florida high school students and their families. Vencer is operated by 426 Labs LLC ("Operator"), a Florida limited liability company.

2. Acceptance of Terms

By accessing or using Vencer at getvencer.com (the "Site"), or by generating a report, you agree to be bound by these Terms of Service. If you are a parent or guardian submitting information on behalf of a student, you represent that you have the authority to do so and that you agree to these terms on behalf of yourself and the student.

If you do not agree to these terms, do not use the Site.

3. Description of Service

Vencer generates AI-powered college planning reports based on information you provide. Each report includes personalized guidance on scholarship eligibility, school selection, application timelines, and extracurricular positioning.

This is not professional counseling. Vencer is an informational tool — not a licensed educational consulting service. Our reports are generated by artificial intelligence and are intended as a starting point for your planning, not as definitive advice. We are not college counselors, financial advisors, or attorneys.

4. No Guarantee of Outcomes

We make no representations or warranties that:

  • Any student will qualify for any scholarship or financial aid program described
  • Any student will be admitted to any college or university
  • The information in any report is complete, current, or error-free
  • Following the guidance in a report will produce any specific outcome

Scholarship requirements, college admissions criteria, and financial aid rules change frequently. Always verify deadlines, eligibility requirements, and program details directly with schools and scholarship organizations before taking action.

5. Your Responsibilities

You agree to:

  • Provide accurate information when filling out the form. Reports are only as good as the data you enter.
  • Use the report for personal, non-commercial planning purposes only
  • Not resell, redistribute, or reproduce reports for commercial purposes
  • Not submit false, misleading, or fraudulent information

6. Payment

Reports are available for a one-time fee of $14.99 (or the current price displayed at checkout). Payment is processed securely by Stripe. We do not store your credit card information.

Refund policy: Because reports are generated and delivered immediately upon payment, all sales are final. If you experience a technical failure that prevented you from receiving your report, contact us at support@getvencer.com within 48 hours and we will either regenerate your report or issue a full refund at our discretion.

7. Intellectual Property

The report generated for you is yours to use for personal planning purposes. You may print, save, and share it with your family and school counselor. You may not resell it or publish it as your own work.

The Vencer platform, including its prompts, software, and design, remains the property of 426 Labs LLC.

8. Data and Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VENCER AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY REPORT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE REPORT IN QUESTION.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Continued use of the Site after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Manatee County, Florida.
